She gave a great overview of current copyright law in Canada and I was able to gain much information. Publishing an academic blog and working in the education field generates a responsibility on my part to become familiar with the do’s and don’ts of the Canadian copyright act.

Copyright law was created to establish a balance between the rights of the user and the rights of the author (Wrobel, 2016, 15:15). Every country has their own specific guidelines, however no matter where the article, book or video was created, copyright act from the country in which you are situated applies (3:34). With the arrival of the internet, copyright law became more complex and today the rapid development in technology often outpaces the law itself (16:08).

Up until now I naively believed a document generated and produced by the government would automatically belong to the public domain, after all, isn’t it our taxes that pay for it? I learned that in fact not all government documents are indeed part of the public domain, meaning that some documents will have a copyright attached and will require a user to seek permission before using it beyond its intended purpose. However the Justice Laws Website (Government of Canada, 2018) states some exceptions to this rule as well, ‘fair dealings’ (sx 29). The website explains

‘It is not an infringement of copyright for an educational institution or a person acting under its authority for the purposes of education or training on its premises to reproduce a work, or do any other necessary act, in order to display it’ (sx 29.4).

I was familiar with other fair dealings guidelines presented by Melanie Wrobel (2016), such as no more than 10% of a copyright protected work, one chapter of a book or one article within a periodical can be used for educational purposes only, without having to get permission (19:00).

I have participated in copyright info sessions before and it has been my experience that I learn something new every time. This makes me aware of the importance to visit institutional policies about copyright regularly or to use the government website to keep up on the ever changing landscape of the copyright act in Canada. After all, the moment something is created, copyright is attached automatically (Wrobel, 2016, 5:34) and unless the author attaches a creative commons license to their work, I may not be able to use it. By the way, this blog has a creative commons license, excluding commercial use. So if you ever want to share anything you read here, go ahead.

References

Government of Canada (2018). Justice Laws Website [website].
